DECREE OF THE MINISTER OF TRADE OF REPUBLIC OF INDONESIA

CONCERNING
ASSIGNMENT OF THE INDONESIAN RUBBER PRODUCER FEDERATION (GAPKINDO) AS THE NATIONAL TRIPARTITE CORPORATION (NTRC)

THE MINISTER OF TRADE OF REPUBLIC OF INDONESIA,

Considering:

• a. that since natural rubber constitutes national asset mostly cultivated by farmers in rural areas, utilization of the commodity needs to be properly and maximally for the welfare of rubber farmers;
• b. that in order to achieve the goal as intended in paragraph a as well as to implement agreement in Join Ministerial Declaration of the World's Main Natural Rubber Producing Countries between the Minister of Industry and Trade of the Republic of Indonesia, Minister of Basic Industry of Malaysia and Minister of Agriculture and Cooperative of the Thai in Denpasar, Bali on December 12, 2007, it is necessary to assign the Indonesian Natural Procedure Federation (GAPKINDO) as the National Tripartite Rubber Corporation (NTRC);
• c. based on the considerations as intended in sub-paragraphs a and b, it is necessary to stipulate a decree of the Minister of Trade;

In view of:

• 1. Government Regulation No. 1/1982 on Export, Import and Foreign Exchange Flow (Statute Book of 1982 No. 1 Supplement to Statue Book No. 3210) as has already been amended by Government Regulation No. 24/1985 (Statute Book of 1985 No. 33, Supplement to Statute Book No. 32910;
• 2. Presidential Decree No. 260/1967 on Affirmation of Tasks and Responsibility of the Minister of Trade in the Foreign Trade Sector;
• 3. Presidential Decree No. 187/M/2004 on Establishment of the United Indonesia Cabinet as has already been amended several times and the latest by Presidential Decree No. 171/M/2005;
• 4. Presidential Regulation No. 9/2005 on First-Echelon Organization Structures and Working Arrangements of States Ministries as has already been amended several times and the latest by Presidential Regulation No. 90/2006;
• 5. Presidential Regulation No. 10/2005 on First-Echelon Organization Units and Tasks of States Ministries as has already been amended several times and the latest by Presidential Regulation No. 66/2006;
• 6. Decree of the Minister of Industry and Trade No. 556/MPP/KEP/12/1998 on Export General Provisions as has already been amended the latest by Regulation of the Minister of Trade No. 01/M-DAG/PER/1/2007;
• 7. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on Organization and Working Arrangement of the Minister of Trade as has already been amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/12/2005;

Observing:

Joint Ministerial Declaration of the World's Main Natural Rubber Producing Countries between the Minister of Industry and Trade of the Republic of Indonesia, Minister of Basic Industry of Malaysia and Minister of Agriculture and Cooperative of the Thai Kingdom in Denpasar, Bali on December 12, 2001.

HAS DECIDED:

To Stipulate:

FIRST:

To Assign the Indonesian Natural Rubber Producer Federation (GAPKINDO) as the National Tripartite Rubber Corporation (NTRC) as intended in Joint Ministerial Declaration of the World's Main Natural Rubber Producing Countries between the Minister of Industry and Trade of the Republic of Indonesia, Minister of Basic Industry of Malaysia and Minister of Agriculture and Cooperative of the Thai Kingdom.

SECOND:

NTRC as intended in Dictum FIRST shall constitute executive of the international Tripartite Rubber Council (ITRC) and function to coordinate and monitor punctually and effectively.

THIRD:

Members of NTRC shall consist of Indonesian Natural Rubber Exporting Producers as members of GAPKINDO.

FOURTH:

GAPKINDO as NTRC shall be assigned to :

• 1. Implement the agreed export tonnage scheme;
• 2. Monitor supply management scheme.

FIFTH:

In executing the tasks, GAPKINDO as NTRC shall be responsible and report in writing to the Director General of Foreign Trade and Director General of International Trade Cooperation of the Ministry of Trade.

SIXTH:

The decree shall come into force as form the date of stipulation and be retroactive to January 31, 2004.
